Child Custody
In any divorce case which involves children, child custody is a matter which must be dealt with, and one which merits serious consideration. There are two aspects of child custody which are considered by the court: physical custody and legal custody.
Physical custody deals with the guardianship of the children who are involved in a divorce case. Typically, most cases fall into one of two scenarios. In the first, one parent is granted sole physical custody of the child, with visitation rights granted to the other parent. In the second scenario, joint physical custody is given, an arrangement which dictates that the child lives with both parents, dividing the time based upon a negotiated schedule.
Legal custody pertains to decisions which are made throughout a child’s life until he or she becomes an adult. Matters regarding religion, education, and medical care all fall under the heading of legal custody, and this right may be granted to a sole parent or to both parents jointly.
